New Delhi: In a significant development, a judge of the Allahabad High Court has withdrawn from hearing criminal proceedings involving Rahul Gandhi, who faces allegations related to holding dual citizenship of India and the United Kingdom.
Judge Steps Aside Citing Social Media Remarks
Justice Subhash Vidyarthi recused himself on Monday, stating that social media posts by the petitioner had influenced his decision. The remarks reportedly criticised the court’s handling of earlier proceedings in the matter.
“Loss of Faith in Court,” Says Judge
In his recusal order, the judge observed that the petitioner’s online statements suggested a lack of confidence in the court. He further noted that instead of correcting his position, the petitioner had blamed the court for procedural issues related to order uploads.
The court stated that under these circumstances, it was not appropriate for him to continue hearing the case.
Case Origin and Allegations Against Rahul Gandhi
The petition, filed by Karnataka-based BJP worker S Vignesh Shishir, alleges that Rahul Gandhi holds British citizenship. It claims he declared foreign nationality in documents linked to a company named Backops Ltd., which was later dissolved in 2009.
The petitioner has sought registration of a case under provisions of the Bharatiya Nyaya Sanhita, the Official Secrets Act, the Foreigners Act, and the Passport Act.
Earlier Proceedings in the Case
Earlier, the court had observed that prima facie cognisable offences could be made out and had allowed the Uttar Pradesh government to consider involving a central agency. However, the judge later paused further action to examine legal questions regarding issuance of notice, after a full court ruling on procedural requirements came to light.
The case was initially filed in a special MP/MLA court in Rae Bareli and later transferred to Lucknow on the petitioner’s request.
