Daughters to get equal rights in property, major amendment made in Land ceiling bill

Daughters in Himachal Pradesh will now also get equal rights in property. In ancestral property, the daughter will also be considered as a separate entity like the son. For gender equality, the Himachal Pradesh government has now made a major amendment in the 51-year-old ‘Himachal Pradesh Land Holding Maximum Limit Act-1972’ (‘Himachal Pradesh Ceiling on Land Holding Act 1972’).

The Land Ceiling Bill passed in the Himachal Pradesh Assembly has got the President’s approval.

In April 2023, the Land Ceiling Bill was amended and passed in the Assembly. With this decision, now the adult daughter (married and unmarried) will also be considered as a separate entity (up to 150 bighas of land) in ancestral property.

The state government has included the word ‘or daughter’ after the word ‘son’ in sub-section 4 of section 4 of the existing Act. After this amendment, the daughter has been included as a separate entity like the son.

Earlier, the Act provided for up to 150 bighas of additional land as a separate entity to an adult son, while an adult daughter was denied the same right.
