Raj Bhavan has no role in accepting the resignation of MLAs: Governor

Shimla : Himachal Pradesh Governor Shiv Pratap Shukla has said that Raj Bhavan has no role in accepting the resignation of three independent MLAs Hoshayar Singh, Ashish Sharma and KL Thakur from the assembly membership.

In this matter he cannot give instructions to the Speaker of the Legislative Assembly, he can only give advice. Accepting the resignation is a matter of jurisdiction of the Speaker of the Legislative Assembly.

In an informal conversation with journalists in Shimla, the Governor said that these independent MLAs had also come to meet the Assembly Secretary after submitting their resignations and these independent MLAs had also submitted a copy of their resignation to him.

The Governor said that he has sent the letter regarding the resignation of the independent MLAs to the Speaker of the Assembly. After the Legislative Assembly Secretary, independent MLAs have also submitted their resignations to the Legislative Assembly Speaker.

He said that Raj Bhavan has no role in accepting the resignation of these independent MLAs and this entire matter depends on the decision or discretion of the Assembly Speaker. The Governor said that in his letter to the Speaker of the Assembly, he has cited the decision given by the Supreme Court in the context of similar cases in Karnataka and Madhya Pradesh Assemblies.


The Supreme Court has said in its decision in this regard that if any MLA personally appears and submits his resignation to the Speaker of the Assembly, then what should be the role of the Speaker of the Assembly. Not only this, it has also been made clear in this decision that if an MLA submits his resignation to the Speaker of the Assembly through post or any other means, then what procedure should the Speaker of the Assembly follow.
