Way for outsourced recruitments clear in Himachal, Supreme Court stays High Court decision

Shimla: The way for outsourced recruitments in Himachal Pradesh has been cleared. The Himachal government had gone to the Supreme Court against the interim orders of the state High Court and the Supreme Court stayed the orders and gave a stay to the government. Now the hearing of this case has been scheduled after four weeks. State government Advocate General Anoop Ratna confirmed this and said that the way for outsourced recruitment has been cleared.

He said that the Supreme Court had stayed the orders of the High Court. The High Court had issued an interim order, against which the government had gone to the Supreme Court. He told that a petition was filed in the High Court regarding the outsourced recruitments done in the year 2022, in which the petitioner had raised questions on the recruitments. In the same case, the petitioner also targeted the ongoing recruitments and the state High Court took suo motu cognizance of it. Taking suo motu cognizance, the High Court also put a stay on the current recruitments.

Now the matter is in the Supreme Court and it will be heard there after four weeks. Till then, with the relief given to the state government, the way for outsourced recruitments has been cleared. The state High Court, taking suo motu cognizance of the matter, had also said whether a phenyl manufacturing company can recruit nurses. In the case going on in the High Court, questions were raised about the recruitment of nurses and pre-nursery teachers. At present, while the Supreme Court’s stay on the interim orders of the High Court has given relief to the state government, there is a hope that the process of outsourced recruitment, which is currently closed, will continue in the future.

The government is giving jobs on outsource basis, due to which unemployed youth are able to get employment. Otherwise, it takes time to get a job on a regular basis and till then government work gets affected. A petition was filed in the High Court on behalf of JK Enterprises on the parameters under which work is given to the company and whether there is transparency. The government filed its reply on this, on which the court expressed displeasure. The matter was heard on 31 December and the High Court gave an interim order and put a stay on this recruitment. Now the Supreme Court will give its decision on this.
