Jaipur Court Grants Divorce, Cites Wife’s Contradictions

Jaipur Court Grants Divorce Over Wife’s Contradictions and Cruelty

Jaipur Court Grants Divorce Over Wife’s Contradictions and Cruelty

In a significant matrimonial ruling, a family court in Jaipur dismissed a wife’s petition for restitution of conjugal rights and granted divorce to the husband, citing contradictions in her allegations and establishing cruelty.

Court Finds Contradictions in Wife’s Claims

The court observed that the wife failed to prove that the husband had withdrawn from her company without reasonable cause. Her statements were found inconsistent and contradictory, weakening her claim under Section 9 of the Hindu Marriage Act. Due to these inconsistencies, the court concluded that her plea for restitution of conjugal rights was not maintainable.

Husband Successfully Proves Cruelty

On the other hand, the husband was able to establish cruelty under Section 13 of the Act. The court accepted his arguments and evidence, holding that the wife’s conduct justified dissolution of marriage. The judgment emphasized that cruelty in matrimonial law includes both mental and emotional distress, not just physical harm.

Failure to Withdraw Criminal Case Weighed Against Wife

A key factor that influenced the court’s decision was the wife’s failure to withdraw a criminal case even after an alleged compromise between the parties. This conduct was considered adverse and contributed to the finding of cruelty against the husband.

Legal Significance of the Judgment

The ruling reinforces key principles under matrimonial law:

Growing Trend in Cruelty-Based Divorce Cases

Courts across India have increasingly recognized mental cruelty as a valid ground for divorce, especially in cases involving false allegations, prolonged disputes, or inconsistent claims.
