ED Justifies Kejriwal’s arrest: calls blatant behaviour and non-compliance with summons responsible

New Delhi: In response to the Supreme Court, the Enforcement Directorate claimed that the arrest of Delhi CM Arvind Kejriwal was legal due to his non-compliance with the summons issued to him.

On Wednesday, ED while filing an affidavit in the supreme court opposed Delhi CM Kejriwal’s plea against the arrest. The probe agency mentioned that he did not cooperate with the central agency despite multiple summonses issued to him.

Arvind Kejriwal was avoiding interrogation by not remaining present before the investigating officer despite being summoned nine times, ED mentioned in the affidavit to Supreme Court.

“Even on the date of the search during his interrogation, while recording his statement under Section 17 of the PMLA (Prevention of Money Laundering Act), he was avoiding answering questions by being evasive and totally non-co-operative even with respect to simple non-incriminating questions,” ED added.

ED also stated that Kejriwal by his conduct has, himself, contributed and aided the investigating officer regarding the existence of the necessity to arrest, apart from the material in possession of the IO to form the satisfaction that he is guilty of the offense of money laundering.

Terming the arrest of Kejriwal as legal, ED said that Kejriwal has been arrested bona fide and not for any mala fide or extraneous reasons. It is categorically denied that the arrest was mala fide.
