A public interest litigation (PIL) has been submitted to the Bombay High Court urging that the Italian fashion brand Prada be ordered to pay compensation to the artisans of Kolhapuri chappals for allegedly copying their traditional design in its latest summer collection.

The PIL emphasizes that the Kolhapuri chappal is registered as a Geographical Indication (GI) under the Geographical Indications of Goods (Registration and Protection) Act, 1999.

Details of the Alleged Copyright Infringement
Filed on July 2, 2025 by IP rights advocate Ganesh S. Hingemire, the PIL claims that Prada’s Spring/Summer collection features ‘Toe ring sandals’ that are visually and culturally similar to the GI-protected Kolhapuri chappal. The petition states that these designer sandals are priced over Rs 1 lakh per pair and are now marketed under a European fashion brand. The petition alleges misrepresentation, cultural theft, and unauthorized commercialization of the GI product during an international fashion event in Milan, Italy, on June 22, 2025, without acknowledging its origin, traditional custodians, or GI status.

Lack of Formal Apology from Prada
Although Prada admitted that its collection was “inspired by Indian artisans” following widespread social media backlash, the petitioners argue that the company has not issued a formal apology or offered damages or compensation to the Indian artisans. They criticize Prada’s statement as superficial and made only after public criticism, not as a formal acknowledgment or apology to the community, government, or the GI registry.

Demand for Government Action and Protection
The PIL demands that the government take steps to protect Indian traditional designs and prevent international companies from infringing on GI products. It calls for strong policies and mechanisms to enforce GI rights and protect the interests of indigenous artisans and communities.

Relief Sought by Petitioners
The petitioners seek directives for authorities to safeguard the rights of Kolhapuri chappal producers, ensure enforcement of GI laws, and provide appropriate compensation and protection for the cultural heritage and economic interests of Indian artisans. Additionally, they seek a public apology from Prada and have requested that the case be heard in the Bombay High Court.
