Will Arvind Kejriwal come out of Tihar? Delhi HC will give verdict tomorrow

New Delhi: The Delhi High Court will give its verdict tomorrow at 2.30 pm on the ED’s plea seeking a stay on the bail of Delhi Chief Minister Arvind Kejriwal. The Delhi High Court had stayed the decision of Kejriwal to get bail from the lower court. Kejriwal had challenged the High Court’s decision in the Supreme Court. His petition was heard in the Supreme Court today.

Arvind Kejriwal’s petition against staying on bail in the liquor scam case was heard in the Supreme Court, but he did not get relief from the court.

While hearing Kejriwal’s petition, during the hearing before the bench of Justice Manoj Mishra and Justice SVN Bhatti, the petitioner said that the High Court was not hearing his petition because a similar case was pending in the Supreme Court.

During the hearing, Justice Manoj Mishra made a very important remark. He said that generally, in stay cases, the decisions are not kept reserved; rather, the orders are passed on the spot. What happened here is unusual.

Advocate Singhvi, who appeared on behalf of Kejriwal in court, said that when the Delhi High Court can put a stay without uploading the order copy, then the Supreme Court can also stay it without the High Court order.

As Singhvi requested the bench pass an order on the plea, the apex court said, “If it passes an order now, it will be pre-judging the issue. It is not a subordinate court, it is a high court.”.
Senior advocate Vikram Chaudhary, also appearing for Kejriwal, told the top court that Kejriwal does not have any criminal antecedents and is not a flight risk.

On June 20, the trial judge granted bail to Kejriwal in the money laundering case.

The next day, the ED moved an urgent petition before the High Court challenging the bail order. The High Court heard both sides extensively reserve orders on the ED’s application to stay the bail order and halted the release of Kejriwal until the pronouncement of its order.
