The Election Commission of India (ECI) has issued fresh guidelines mandating a paid holiday for voters in poll-bound states and Union Territories to ensure maximum participation in the democratic process. The move comes ahead of upcoming Assembly elections and bypolls scheduled across multiple regions in April 2026.
The Commission emphasized that all eligible voters employed in any establishment whether public or private must be given adequate time off or a full paid holiday on polling day.
Legal Provision and Mandatory Compliance
Invoking provisions of the Representation of the People Act, 1951, the ECI clarified that every employee entitled to vote must be granted a paid holiday on the day of polling. Importantly, no deduction in wages can be made for this leave.
The directive applies broadly to workers across sectors, including industrial, commercial, and service establishments. The Commission has reiterated that the law is binding and must be strictly followed by employers.
Warning Against Violations
The ECI has issued a strong warning to employers, stating that any violation of these provisions will attract penalties. Employers attempting to deny leave or deduct wages could face legal consequences.
The poll body has directed state and Union Territory administrations to ensure strict enforcement of these guidelines and take action against non-compliance.
Coverage Includes Daily Wage Workers
In a significant step toward inclusivity, the Commission has clarified that the rule also applies to:
- Daily wage earners
- Casual workers
- Temporary employees
All such workers are entitled to a paid holiday, ensuring that economic constraints do not prevent them from exercising their voting rights.
Benefit for Outstation Voters
The guidelines also extend to voters working outside their registered constituencies. Such individuals must be granted leave to travel and cast their vote in their home constituency.
This provision aims to remove logistical barriers and improve voter turnout across regions.
Poll Schedule and Affected Regions
Assembly elections will be held in:
- Assam, Kerala, Puducherry – April 9
- Tamil Nadu – April 23
- West Bengal – April 23 & 29 (two phases)
Additionally, by-elections are scheduled in several constituencies across states like Goa, Gujarat, Karnataka, Maharashtra, Nagaland, and Tripura.
State governments have already announced public holidays on polling days, with government offices, institutions, and educational establishments remaining closed.
