SC rejects Minister Vijay Shah’s apology; Orders SIT probe, Stays his arrest

The Supreme Court has rejected the apology of Madhya Pradesh minister Kunwar Vijay Shah, who made a controversial statement on Indian Army officer Colonel Sofia Qureshi.

Bhopal, May 19: The Supreme Court has rejected the apology of Madhya Pradesh minister Kunwar Vijay Shah, who made a controversial statement on Indian Army officer Colonel Sofia Qureshi. However, his arrest has also been stayed.

Along with this, a Special Investigation Team (SIT) has been formed to investigate the case. It will have three IPS officers and all will be from outside Madhya Pradesh cadre. One of these officers will be a woman.

During the hearing, Shah’s lawyer said that his client has apologised. To this, the court said that sometimes apologies are made to save oneself, and sometimes they are like crocodile tears. What do you mean? The kind of lewd comments he made, that too without thinking…now you are apologising for that.

In fact, on May 14, the Madhya Pradesh High Court itself took notice and ordered to register an FIR against Shah. An FIR was registered against him at Mhow police station in Indore. Shah had approached the Supreme Court against this.

Shah had called Colonel Sofia the sister of terrorists

Minister Vijay Shah had said about Operation Sindoor at the Halma program held in Raikunda village of Mhow, Indore on May 11, ‘They killed our Hindus by stripping them of their clothes and Modi ji sent their sister to their house to kill them.’

Shah further said- ‘Now, Modi ji cannot take off terrorists’ clothes. That is why he sent a sister from their community, saying that you have made our sisters widows, so the sister of your community will come and strip you naked. We can take revenge for the honor of the country and the marital life of our sisters by sending the sisters of your caste and community to Pakistan.’

Let us tell you that after Operation Sindoor, Colonel Sofia Qureshi, Wing Commander Vyomika Singh and Foreign Department Secretary Vikram Misri were giving information about the operation and other information through a press conference.

The Bench of Justice Surya Kant and Justice N Kotiswar Singh ordered constitution of a Special Investigation Team (SIT) of three IPS officers of Madhya Pradesh cadre to probe the matter. It asked the Director General of Police to constitute the SIT by tomorrow.

We are constituting a SIT with three IPS officers and one should be the rank of IG or DGP rank. All of them should be [from] outside the State. It is a litmus test and we want the state to submit the SIT report to us. We would like to have a very close watch,” the Court said.

Meanwhile, the Court stayed Shah’s arrest and ordered him to join the investigation.

Today, the top court issued notice on Shah’s petition and ordered that an SIT will probe the matter.

Having gone through the statements by the petitioner and the FIR, we are of the opinion that the subject FIR shall be probed by a SIT with three senior IPS officers… Let the SIT be constituted by tomorrow. Let one member be a woman officer. Both members shall be above the rank of superintendent of police. The head member shall not be below the rank of IG or DGP. Let the petitioner co-operate. As of now his arrest shall remain stayed. Though we are not inclined to monitor the probe, in the peculiar facts and circumstances of the case, we direct the SIT to submit the outcome of its probe through a status report before this court. The first report shall be filed and the case be taken up in the first week of vacations,” the Court ordered.
