By-elections are to be held in Ludhiana, Punjab on June 19. Before this, the Election Commission has banned opinion polls. The Election Commission has registered an FIR against several online channels in Ludhiana. According to the Election Commission, an FIR (number 0030/2025) has been registered under section 126 of the Representation of the People Act, 1951 and section 223 of BNS 2023 in connection with the publication of opinion polls in connection with the Ludhiana West by-election.
Publication or broadcast is prohibited 48 hours in advance
The publication of the opinion poll is in violation of the guidelines issued by the Election Commission of India, which prohibit the publication or broadcast of opinion polls in the electronic media during the period of 48 hours before the end of polling.
The complaint was formally lodged by the Returning Officer of 64-Ludhiana West Assembly Constituency. Publication of such surveys is seen as an attempt to influence voter perception/opinion and electoral response, thereby harming the integrity of the electoral process.
It is noteworthy that several complaints were received against some online channels for publishing opinion polls during restricted hours and on this basis, Cyber Crime Police Station, Ludhiana has registered an FIR under Section 126A of the Representation of the People Act, 1951 and Section 223 of the Indian Penal Code, 2023 and further investigation is being conducted.
Strict action will be taken as per law against any person or organisation found guilty of violating the instructions of the Election Commission.
