Load of Cases of Chandigarh on PHRC, Administration should take decision on providing employees: High Court

Chandigarh: Punjab and Haryana High Court has ordered the Chandigarh UT administration to take a decision within 6 weeks on the demand of providing staff to the Punjab Human Rights Commission for its smooth functioning. The Commission is also currently hearing cases related to human rights violations in Chandigarh, hence a demand was made in the petition to issue instructions to the administration.

Advocate HC Arora told the High Court that the Government of India, by issuing a notification on 05 August 2021, had given the Punjab State Human Rights Commission the authority to deal with the cases of Chandigarh also. The petitioner said that for this the Human Rights Commission would naturally require additional staff.

As a result, the Punjab State Human Rights Commission has directed the Chandigarh Administration to provide additional staff including one legal assistant, three private secretaries, one personal assistant, one police inspector, one head constable, one senior assistant, two clerks, two data entry operators, two drivers and one class IV employee. A letter was written to provide a total of 16 people to the state Human Rights commission.

It should be noted that despite a lapse of more than two years, only two ASIs have been deputed to the Commission by the UT Chandigarh Administration, resulting in the work of the Commission being affected. In such a situation, the petitioner has filed this PIL after receiving all the documents from the Punjab State Human Rights Commission. A division bench of High Court Acting Chief Justice Justice Ritu Bahri and Justice Nidhi Gupta has directed the UT administration to inform the Punjab government regarding the decision within six weeks.
