Former DSP gets Life imprisonment sentence in fake encounter

Former DIG sentenced to 7 years imprisonment; kidnapped and shot 31 years ago.

Punjab: On Friday the CBI Special Court of Mohali pronounced its verdict in the 31-year-old fake encounter case in Tarn Taran, Punjab. The court has sentenced former DIG Dilbagh Singh to 7 years of imprisonment and retired DSP Gurbachan Singh to life imprisonment. The court had convicted both of them a day earlier.

The court has sentenced both of them under IPC sections (364) kidnapping, 302 murder, 218 (public servant preparing false report record with intent to save a person from punishment or confiscation of property) and (201) destruction of evidence.

The family of the deceased fought a long battle for justice in this case.

The family says that the police officers had taken Gulshan away accusing him of terrorism. They should have been sentenced to death. We are not satisfied with this decision.

The case was registered in 1996 on the complaint of Jandala Road resident Chaman Lal. He had said in the complaint that on 22 June 1993, a team of Tarn Taran police led by the then DSP Dilbagh Singh (retired from the post of DIG) forcibly took away his son Gulshan. Apart from this, his 2 sons Praveen Kumar and Bobby Kumar were also taken with them.

The police released Praveen and Bobby Kumar, but did not release Gulshan. A month later, on 22 July 1993, Gulshan was killed in a fake encounter. He alleged that the police cremated his son’s body without informing him. According to father Chaman Lal, Gulshan Kumar was a fruit seller.

According to the CBI investigation report, Gurbachan Singh was a sub-inspector at that time and was posted as SHO at Tarn Taran (city) police station. He had kept Gulshan Kumar in illegal custody. Arjun Singh, Davinder Singh and Balbir Singh have died during the hearing in this case. Apart from this, 32 witnesses were cited in this case, but only 15 people testified. The complainant of the case, Chaman Lal, has also died.

CBI legal officer Anmol Narang and complainant’s advocate Sabarjit Singh Verka had demanded life imprisonment for those who killed an innocent vegetable seller. The family says that Gulshan had nothing to do with terrorism. Despite this, this stigma was put on their family. The family suffered for more than 30 years. During this time their house was completely ruined. His father left this world.
