Arvind Kejriwal will remain in jail; High Court denied bail

Delhi High Court will give its verdict today at 2:30 pm on whether Delhi CM Arvind Kejriwal will get bail or not. Rouse Avenue Court had granted bail to Kejriwal on June 20, but the High Court had stayed the ED's plea on June 21.

New Delhi: Delhi High Court has refused to grant bail to Delhi CM Arvind Kejriwal. The court said – the arguments were not argued properly, so the decision of the Rouse Avenue Court is quashed.

The comment of the trial court cannot be considered. It is completely unfair. It shows that the trial court has not applied its mind on the material.

The court should have given ED enough opportunity to argue on the bail application.

The Rouse Avenue Court had granted bail to Kejriwal on June 20, but the High Court had stayed the ED’s plea on June 21. Now the case will be heard in the Supreme Court tomorrow (Wednesday).

ED’s lawyer had told the court that whatever necessary documents were placed before the vacation bench of the trial court, the bench did not consider it necessary to pay attention to it. These documents contained evidence that Kejriwal is fully involved in the money laundering case.

According to ED, Aam Aadmi Party had a major share in the black money accumulated from the Delhi liquor scam. The vacation bench has erred in ignoring Kejriwal’s role under the Prevention of Money Laundering Act (PMLA).

The Supreme Court said – it is right to give the decision only after the order of the High Court

On the other hand, Kejriwal had filed a petition in the Supreme Court against the order of the High Court on June 23. His petition was heard on Monday (June 24). The Supreme Court said that the High Court has not yet given its verdict, so it would not be right to give any order before that. One should wait a little.

Justice Mishra said that it is unusual for the High Court to reserve the decision. Usually the decision in the stay petition is given at the same time. With this, the Supreme Court postponed the hearing till June 26.

The lower court had said – ED does not have direct evidence against Kejriwal
The Rouse Avenue Court had granted bail to Arvind Kejriwal on June 20 at 8 pm. The bench of Judge Nyay Bindu had said that the ED does not have any direct evidence against Arvind Kejriwal. The court had granted bail to Kejriwal on a bail bond of Rs 1 lakh.
