Shimla:  Former Himachal DGP Sanjay Kundu Versus businessman Nishant Sharma extortion and threatening case, the High Court said that,  the report filed by the DGP Atul Sharma shows that there were many flaws in the SIT investigation and the investigation was also slow. The SIT did not investigate many important aspects. Court said that  the SIT report shows that the SIT was committed to proving the alleged attack on the complainant wrong, while the investigation should have been on the aspect of extortion.

High Court Praised DGP Atul Sharma

High Court also praised the current Director General of Police Atul Verma. Atul Verma had submitted his report to the High Court, finding flaws in the SIT investigation. A division bench of Chief Justice MS Ramachandra Rao and Justice Jyotsna Rewal Dua said in its orders, they appreciate DGP Atul Verma for the independent, unbiased views expressed by him in the report and the valuable suggestions given by him.

The court said that, serious allegations like extortion, attempt to extort money, land grabbing etc. were never investigated by the SIT or other investigating officers. The court said that, it would be a mockery of justice to ignore the views of DGP Atul Verma on the manner of investigation of the complaint filed by Nishant. In this case, there is a need for a thorough investigation into the motive or reason for the alleged extortion or attempt to extort money from the complainant.

The court ordered that sections 384 to 387 IPC be added to the FIR before the police station McLeodganj in this case and it should also be investigated by the SIT. The court has asked the SIT to further investigate all the aspects mentioned in the report filed by the DGP.

The court ordered the addition of an SP level officer of the Himachal Pradesh Armed Police Battalion approved by the DGP as a member of the SIT constituted by the state government and ordered to issue a proper notification in this regard within 3 days.

Nishant had sent a complaint to the High Court through email

The applicant has written that he is worried and scared that he will either be killed or badly intimidated by the state DGP. The businessman has written that he has been attacked in Gurugram too. He survived that attack. To withdraw the report of this incident, two bike riders stopped him on the way between Bhagsunag and McLeodganj and intimidated him. According to the email, he received 14 calls from the DGP office in a single day. DSP and SHO Palampur also called him.

SHO Palampur told through WhatsApp message that DGP wants to talk to him. Therefore he should call back to his office. On calling back, DGP said that Nishant you come to Shimla and meet me. On this, when he asked why he should meet him, DGP said that he will have to come to Shimla and meet him. Through email, Nishant has talked about two influential people of Himachal putting pressure on him for extortion. Taking cognizance of the email, the Chief Justice had given administrative orders to register it as a criminal writ petition.
