MP Amritpal Singh Challenges NSA in High Court for Third Time, Alleges Violation of Rights

Chandigarh: Amritpal Singh, MP from the Khadoor Sahib Lok Sabha seat, has filed a petition in the Punjab and Haryana High Court for the third time, terming the imposition of the National Security Act (NSA) against him as completely illegal. He said it is a gross violation of constitutional rights.

Jailed since 2023, detention extended without any new reason

Amritpal Singh has been in jail since 2023. The petition claims that the government has extended his detention under the NSA without any new or concrete reason. He has no direct involvement in the cases on the basis of which the NSA was extended. According to the petition, some of the incidents took place when he was in Dibrugarh Jail.

Witness statements questioned

Amritpal told the court that the witnesses presented by the police are not credible. There are constant contradictions in their statements and no concrete evidence is available. Based on this, he questioned the process of implementing the NSA.

Questions were also raised about the authority of the District Magistrate

The petition also said that the District Magistrate (DM) does not have the authority to issue detention orders under Section 3(2) of the NSA. Only the state or central government can issue such an order. He also cited a Supreme Court judgment which said that the DM can issue the order only if there is an immediate danger in the area – which was not the case in this case.

Delay in sending report to government

As per Section 3(4) of the NSA, a report on the detention order should be sent to the government immediately, but this time the report was sent after nine days. The petition also describes this as a serious procedural error.
