Amritpal Singh Approaches High Court Over Denied Parole for Parliament Session

Chandigarh: Punjab’s pro-Kalistian MP Amritpal Singh has again filed a parole petition in the Punjab and Haryana High Court. He has challenged the Punjab government’s decision to deny him parole to attend the Parliament session. The matter will be heard on Monday.

The High Court had issued an order in the previous hearing.

In the previous hearing, the High Court had directed the Punjab government to take a decision on Amritpal’s parole within a week. However, the government had rejected this request. The Deputy Commissioner and SSP of Amritsar had said that granting parole to Amritpal could worsen the law and order situation.

Amritpal is currently lodged in Dibrugarh Jail in Assam under the National Security Act (NSA). While in jail, he won the 2024 elections from Khadoor Sahib constituency, securing a majority of about 200,000 votes.

The government cited the threat to law and order.

According to sources, based on reports from the Amritsar Deputy Commissioner and district police officers, the government said that the law and order situation could deteriorate if Amritpal is released. Amritpal’s lawyer cited Section 15 of the NSA, which gives the prisoner the right to parole in special circumstances. The case was transferred to the Punjab and Haryana High Court on the directions of the Supreme Court.

Amritpal’s father’s statement

Amritpal’s father Tarsem Singh said that the purpose of the parole was only to attend the winter session of Parliament and express his views on important issues related to Punjab and the Sikh community. The parole was never sought for personal work or a visit home.

Three points from the High Court

The issue of speaking in Parliament: Senior advocate R.S. Bains told the High Court that Amritpal is likely to speak in Parliament on the issue of flood relief.

Application to District Magistrate: Assistant Solicitor General Satyapal Jain said that only the competent state authority can allow the MP to go to Parliament. Bains said that the application for parole has been submitted to the Punjab government and the District Magistrate.

Government’s response: Additional Advocate General Chanchal Singh said that Amritpal’s letter was just a representation, not an official application. The high court ordered the government to consider the application and take a decision within a week.

The next hearing of the case will be on Monday, and it could prove decisive for Amritpal’s participation in the Parliament session.
