Indian Child Custody Law Does Not Recognise Joint Parenting: Bombay HC

The Bombay High Court has stated that Indian child custody and guardianship laws do not recognize ‘joint parenting’ as a legal concept. The court stated that the child’s interests and welfare should be of paramount importance in custody matters.

    50:50 parenting arrangement cancelled

The High Court has overturned a family court order directing a divorced couple to adopt a 50:50 parenting arrangement for their 14-year-old son, including equal distribution of vacation time between the two parents.

The child’s best interests are paramount

The court stated that the law does not mandate equal division of custody or parenting time between parents. The decision should be made taking into account factors such as the child’s education, health, emotional state, and overall development.

Shared parenting possible if there is cooperation

The High Court also stated that if shared parenting is in the child’s best interests and both parents are willing to cooperate, such an arrangement can be considered. However, 50:50 parenting cannot be enforced as a legal right.
