    CEC Gyanesh Kumar Faces ‘People’s Impeachment Notice’ Over Six Allegations

    New Delhi: A group of former bureaucrats, social activists, and civil society members has issued a ‘People’s Notice of Impeachment’ against Chief Election Commissioner (CEC) Gyanesh Kumar. The group alleges alleged violations of constitutional and statutory provisions in the functioning of the Election Commission.

    The delegation included former Lieutenant Governor of Delhi Najeeb Jung, former Union Home Secretary G.K. Pillai, and social activist Yogendra Yadav. According to the group members, they intended to meet the CEC at the Election Commission’s office to submit the notice, but were prevented from entering the premises. Subsequently, they held a press conference at the Press Club.

    Six key allegations in the notice

    The document issued by the group is described as a ‘Chargesheet and Notice of Impeachment’. Citing Article 324(5) of the Constitution, it alleges alleged “proven misbehavior” against the CEC. The notice primarily raises six issues:

    Allegations of undermining the collective functioning of the Election Commission, claiming that the entire Commission lacked adequate participation in key decisions.
    Allegations of alleged unauthorized changes to Form 6, used for adding names to the electoral roll.
    Allegations of centralization of electoral roll management through ECINET, which the group claims impacted the statutory role of Electoral Registration Officers.
    Allegations of large-scale deletion of voters through SIR.
    Questions about the independence and impartiality of the Election Commission, including objections to the CEC’s conduct and public statements.
    Allegations of alleged violations of statutory responsibilities, particularly in matters related to electoral forms, records, and voter roll management.

    Claims of being prevented from entering the ECI office

    The delegation had demanded to meet CEC Gyanesh Kumar and hand over the notice. However, the group claims that they were prevented from entering the Election Commission premises due to police barricades. Members then presented their views at the Press Club.

    Form 6 issue also raised in the Supreme Court

    This development comes as the Supreme Court is hearing cases related to the functioning of the Election Commission and the Special Intensive Revision (SIR).

    The Supreme Court issued notices to the Central Government and the Election Commission on a petition alleging unilateral decisions by the CEC, although the court did not order the suspension of Gyanesh Kumar from his post.

    During the hearing, Chief Justice Surya Kant stated that the Supreme Court had not approved any changes to Form 6. The court requested to review the records to determine who made the changes.

    Allegations yet to be judicially confirmed

    The allegations made in the People’s Notice are claims made by members of the delegation and cannot be considered judicially confirmed by any court against CEC Gyanesh Kumar. Many issues related to these allegations are currently pending under various legal proceedings.
