Chester Hills Dispute: TCP Norms also flouted; Department Launches Investigation

The noose is tightening around Solan’s much-talked-about Chester Hill residential project. Plagued by controversies, the project is now also under investigation by the Town and Country Planning (TCP) Department. Given the gravity of the matter, Town and Country Planning Minister Rajesh Dharmani has sought a report from the department, a move that could lead to major revelations in the coming days.

According to sources, the most significant controversy surrounding this project centers on basic amenities such as roads and drinking water supply. It is alleged that established standards and TCP guidelines were disregarded during the construction phase. Although in urban areas, the powers of the TCP Director typically vest with the Municipal Commissioner through whom necessary permissions are granted, adherence to guidelines remains mandatory.

If the investigation substantiates any violation of regulations, construction work could be halted immediately under the provisions of the Himachal Pradesh Town and Country Planning Act, 1977. Furthermore, in cases involving serious issues related to roads and water supply, punitive action potentially extending to declaring the project “non-compoundable” is a distinct possibility.

Should such a scenario unfold, regularizing the project would become an arduous task. Additionally, if the issuance of the Occupancy Certificate is withheld, handing over possession of the flats would be deemed legally unlawful. It is pertinent to note that the Chester Hill project has been embroiled in controversies on several previous occasions, with residents raising objections regarding basic amenities and environmental impact. With the TCP Department now stepping into the fray, the controversy appears poised to escalate further.

A detailed report on the project has been requisitioned from the department, and every facet of the undertaking will be subjected to scrutiny. If any violation of TCP guidelines is detected, appropriate action will be initiated in strict accordance with the applicable regulations.
