Major relief to Sukhu govt, Supreme Court stays HC’s order which called appointment of CPS ‘unconstitutional’

New Delhi: The Supreme Court on Friday stayed the disqualification of six Chief Parliamentary Secretaries (CPS) appointed by the Himachal Pradesh government. This decision has been given against the order of the Himachal Pradesh High Court, in which the appointment of Chief Parliamentary Secretaries and Parliamentary Secretaries was declared unconstitutional.

The Sukhwinder Singh Sukhu-led Himachal Pradesh government had appointed six MLAs as Chief Parliamentary Secretaries. This decision was challenged in the High Court by Bharatiya Janata Party (BJP) leader Kalpana Devi. The High Court disqualified them, calling this appointment unconstitutional.

A bench of Chief Justice Sanjiv Khanna and Justice Sanjay Kumar stayed the order of the High Court and said that no further action would be taken in this matter at present. However, the court also made it clear that no new appointments would be made by the state government, as it would be against the law.

The Supreme Court has also issued a notice to BJP leader Kalpana Devi and sought a reply from her in two weeks. The court has listed this case for hearing again after four weeks. This case has been linked with the already pending petitions.

There have been controversies over the appointment of Chief Parliamentary Secretaries in the past as well. The opposition alleges that the government uses these appointments to satisfy the MLAs by giving them lucrative posts. In Himachal Pradesh, this case is not only important from the constitutional point of view, but has also become a political tussle between the ruling Congress and the opposition BJP.
