Damanvir S Phillaur Questions Niranjan’s Neutrality as IO in PMLA Trial

Damanvir S Phillaur has raised questions over the neutrality of Niranjan, the Investigating Officer (IO) in a pending PMLA trial before the  CBI Court in Mohali.

A BIG QUESTION?

HAS NIRANJAN LOST JUDICIAL WEIGHT?

He is the IO in a pending PMLA trial in the CBI Court, Mohali. By joining a political party during that trial, he has ceased to be a neutral official witness.

One accused, Avinash Chander former #MLA , belongs to the #BJP . The IO is now a political rival. That is a conflict.

His old investigation stays on file. His present word does not carry the same weight. A witness who takes a political side mid-trial cannot be treated as an impartial officer.

This act costs him judicial weight.

Political Role During Ongoing Trial

Phillaur said Niranjan’s decision to join a political party while the trial is ongoing raises questions about his position as an official witness.

Questions Over Impartiality

Phillaur also referred to former MLA Avinash Chander, one of the accused in the case, who belongs to the BJP. He argued that Niranjan’s political involvement could create a perceived conflict.

Court to Decide Evidentiary Weight

Phillaur questioned whether the court may examine the IO’s evidence with greater scrutiny in view of his political role. The final assessment of the evidence and any question of impartiality will be determined by the court based on the facts and applicable law.
