Shimla: Congress’ Rajya Sabha election candidate from Himachal Pradesh and Supreme Court advocate Abhishek Manu Singhvi filed a petition in the Himachal High Court on Saturday. In this petition , he has challenged the rule of declaring victory by draw. He said that if two candidates get equal number of votes, then the formula for drawing lottery is wrong.
Abhishek Manu Singhvi said that he has challenged an assumption of the rule in the petition. He said that when the competition becomes a toy. After that the slip is taken out. The one whose slip is drawn should be declared the winner. But, the one whose slip comes out now has been declared the loser. This notion is legally incorrect.
Singhvi Mahajan got equal number of votes in Rajya Sabha elections.
He said that whoever’s name appears in the slip should win. Whoever has given this notion in the rules is wrong. Said that there is no such rule in the Act, but this assumption is there in the rules. He has been challenged. If this assumption is wrong then the results declared in the elections are also wrong.
Singhvi said that the elections are over. There should not be any kind of politics in this. This is a legal process. The election has been challenged on legal grounds.
Singhvi and Mahajan got 34-34 votes
In fact, in the Rajya Sabha elections held on February 27 in the state, Abhishek Manu Singhvi of Congress and Harsh Mahajan of BJP got 34-34 votes. After the contest was toy, Harsh Mahajan won the election through lottery, because the slip was for Abhishek Manu Singhvi.
