The Punjab and Haryana High Court has given a big blow to the Haryana Staff Selection Commission (HSSC). The High Court has quashed the decision of HSSC, through which the certificates of backward class candidates were rejected and the candidates scoring more marks were included in the unreserved category.
The bench of Justice Jagmohan Bansal has written in the decision that the disputed orders are quashed. To avoid filing further petitions, it is made clear that the benefit of this decision will be available to all those candidates who have been transferred from backward caste to the general category.
The High Court raised these points in the decision
The High Court has written in its detailed order that it can be concluded from the quoted section of the recruitment advertisement and notification that the respondent (HSSC) was able to verify the claim of the applicants regarding caste and family income, property from the Parivar Pehchan Patra (PPP).
This facility was available at the time when the applications came. The applicants have passed the CET as well as the second stage examination. There was no question of denying him the benefit on this ground. The argument that the applicant had not submitted the latest fresh BC certificate is baseless.
The court gave this example in its decision
The High Court has written in the decision that the notification of 17 October 2021 and the instructions of 22 March 2022 show that the BC certificate contains income and property based information. It is valid till 31 March from the date of issue.
