Setback for Ram Rahim: HC cancels order, case will run again in CBI court in matter of making sadhus impotent

The High Court has sent the case back to the CBI Special Court and ordered to take a fresh decision on it.

Chandigarh: Dera Sacha Sauda chief Ram Rahim, lodged in Sunaria jail in Rohtak, Haryana, has received a major setback from the Punjab Haryana High Court. The case of making sadhus impotent in the name of introducing them to God was heard in the High Court on Friday. During the hearing, the Punjab-Haryana High Court quashed the decision of the CBI Special Court to hand over the case diary of the case related to making sadhus impotent to the Dera chief. The High Court has sent the case back to the CBI Special Court and ordered to take a fresh decision on it.

The CBI had filed a petition in the High Court in 2019, challenging the decision of the CBI special court in Panchkula. The CBI court had ordered Ram Rahim to provide this case diary, witness statements and other documents to prepare his defense. The High Court itself had ordered to hand over the investigation of the case of making sadhus impotent in the Dera to the CBI. The CBI had investigated the matter and submitted a sealed status report to the High Court. This case is now going on in the CBI trial court of Panchkula.

In 2019, on an application by the Dera chief, the trial court had ordered the CBI to hand over the case diary of this case to him. The CBI had challenged this order in the High Court. The High Court said that this order of the CBI special court was wrong. The statements given to the police have no importance, so there is no justification in handing over the testimony of 87 witnesses to Ram Rahim.

While issuing the order, the special court did not consider what is the justification for providing the documents that are being sought. In such a situation, now the High Court cancels the order and sends the case back to the CBI court so that a fresh decision can be taken after considering these facts.
