Himachal: High Court expresses displeasure over Ayushman-Himcare payment delay; directs to clear dues

The Himachal High Court has strongly criticized the central and state governments regarding pending payments to private hospitals registered under Ayushman Bharat and the state government’s Himcare scheme. The court clarified that if hospitals providing cashless treatment do not receive timely reimbursements, the very purpose of such welfare schemes will be defeated.

This order was passed by a single bench of Justice Jyotsna Rewal Dua during the hearing of the case, MS Matri Medicity & Orthocare Hospital vs. State of Himachal Pradesh and others. The petitioner informed the court that it treated eligible beneficiaries under Ayushman Bharat and Himcare schemes at the approved package rates, but despite completing all formalities, its bills are pending payment.

The hospital argued that claims were uploaded to the designated portal, necessary documents were submitted, and scheme guidelines were followed. Despite this, the delay in payments is increasing financial pressure on the hospital and impacting regular healthcare services.

Cashless treatment jeopardized if payments are not made
The court stated in its order that schemes like Ayushman Bharat and Himcare have been implemented to provide quality healthcare services to economically weaker sections without advance payment. If timely payments are not made to empanelled hospitals, the entire cashless treatment system could be jeopardized.

The single bench directed the central and state governments, as well as the relevant implementing agencies, to examine the petitioner’s pending bills and ensure timely payment of the due amount in accordance with the scheme’s rules. The court also clarified that administrative delays or procedural hurdles cannot be grounds for withholding payments.
