Himachal Pradesh: High Court dismisses petition for reappointment of PTA teachers, Read to know matter

The Himachal Pradesh High Court has dismissed a petition filed by a PTA (Parent-Teacher Association) teacher seeking reinstatement of her services, citing delay and laches. The petitioner had sought reinstatement of her services under the PTA scheme as a Lecturer (Sanskrit).

The single-judge bench of Justice Jyotsna Rewal Dua delivered the judgment. The petitioner, Kusum Kumari, had sought reinstatement of her services as a lecturer under the PTA scheme in light of the notification dated May 22, 2014, and the judgment in the case of Ashwani Kumar Sharma vs. State of Himachal Pradesh.

The petitioner claimed that she was appointed on a PTA basis on February 27, 2007. Her services under the PTA scheme were terminated on September 30, 2008, in light of the judgment. The petitioner argued that several other PTA teachers in similar situations had been reappointed after the May 22, 2014 notification.

The court found that the petitioner had approached the court for reinstatement of services after an inordinate delay.

The petitioner’s services were terminated on September 30, 2008. Even after the issuance of the reappointment notification on May 22, 2014, or the judgment in the Ashwani Kumar Sharma case on April 1, 2014, the petitioner did not submit any representation.

The first representation made by the petitioner for reappointment was on August 5, 2025. The court dismissed the petition on these grounds.
