Himachal: Transfer of teachers who have worked in difficult areas is responsibility of govt: HC

The Himachal Pradesh High Court has clarified that if an employee completes their tenure in a difficult or tribal area, it is the government’s responsibility to transfer them from there. The court stated that if this is not done, posting in these areas will be viewed as a punishment.

Judge Ajay Mohan Goyal’s court stated that if employees lack confidence that they will be transferred after their tenure is complete, no one will volunteer to serve in difficult areas. Failure to transfer on time will result in postings in these areas being considered punishment postings. Transfer of teachers who have completed their tenure in difficult areas is not a punishment, but a right.

The court, while quashing the January 31 order, directed the respondent Education Department and the government to transfer the petitioner from his current position to another area within four weeks and appoint a new person in his place. The state government argued in court that the petitioner was not transferred because it could affect his children’s education. However, the court rejected this argument, stating that the department’s approach was arbitrary.

The petitioner, a teacher currently posted at the Government Senior Secondary School, Kathog, in Mandi district, stated in his petition that he had completed his normal tenure in this difficult area, yet the department issued an order on January 31, 2026, rejecting his transfer request. The petitioner challenged this order in the High Court, which has now issued this decision.

Seniority list records must be presented.
The Himachal Pradesh High Court has taken a tough stand in a case involving the seniority and promotion of Physical Education Lecturers (DPEs). Hearing the case, Justice Ajay Mohan Goyal directed the Education Department to submit the seniority of the petitioning lecturers, as determined by the department, to the official record at the next hearing. The next hearing will be held on March 25th. An execution petition has been filed by the DPE Association in this matter.
