Himachal: Contract workers to get the benefit of revised pay scale, state High Court clarifies

The Himachal Pradesh High Court has clarified that the benefit of Revised Pay Scale 2022 will also be available to those employees who have been regularized after the implementation of these rules. The court of Justice Jyotsna Rewal Dua said that all the petitioners had completed two years of continuous contract service by October 2021.

Their services were regularized in April 2022. The court has directed the state government to reconsider the cases of the petitioners under the Revised Pay Scale Rules 2022 in accordance with the decision of Mohit Sharma in three weeks.

The court has also quashed the office order of July 25 issued by the department, under which the department had refused to give revised pay scale.

The court said that the petitioners were regularized after the implementation of Revised Pay Rules 2022, they cannot be denied its benefit. According to the rules, such employees will get benefits even after being regularized. During the hearing, the High Court found that the respondent department has not understood the decision of Mohit Sharma correctly.

It was clearly stated in the case that irrespective of the nature of the employee’s previous job, be it contract or temporary, he becomes a part of the general category after being regularized.

After being regularized, the employee will also be entitled to get the benefit of Revised Pay Scale Rules 2022. The single bench had said in the Mohit Sharma case that all those who have completed 2 years of contract service till 30 September 2021 will be given the benefit of this higher pay scale 2022.
