Himachal: Strict action against cheating in recruitment exams; up to ten years jail; Rs one crore fine

To ensure transparency in recruitment examinations in Himachal Pradesh, the state government has issued a notification making the Public Examinations (Prevention of Unfair Means) Act, 2025, effective from February 9th. The Act will now impose legal penalties on cheating, question paper leaks, fraud, and organized examination crimes.

Those involved in cheating or facilitating cheating in recruitment examinations will face a minimum of five and a maximum of ten years imprisonment and a fine of one crore rupees.

This offense has been made non-bailable and cognizable. Other individuals involved will face a minimum of three years and a maximum of five years imprisonment and a fine of ten lakh rupees.

According to the notification issued by the Personnel Department, the Governor, exercising the powers conferred under sub-section (2) of Section 1 of the Act, has declared the date of its enforcement.

With the implementation of the Act, offenses related to recruitment examinations will be categorized as non-bailable, and strict penal provisions will come into effect. The Act provides for stringent punishments and heavy fines for cases of cheating, question paper leaks, manipulation of examinations through digital means, tampering with answer sheets, and impersonation.

The penalties will be even stricter in cases of organized crime. The accountability of examination conducting agencies and their employees has also been established. The Himachal Pradesh Public Examinations (Prevention of Unfair Means) Act, 2025, was passed by the State Assembly in 2025.
