The division bench of Justice Tarlok Singh Chauhan and Justice Sandeep Sharma said that if the orders are not complied with before the next hearing, then the Additional Chief Secretary Home will have to appear in the court personally with the record. The next hearing of this case will be on 23 April.
A petition was filed in the court in the year 2018 on behalf of Himachal Pradesh High Court Non-Gazetted Employees Union. In the petition, it was demanded to give grade pay with an increase of 20 percent from January 1, 2006 to bring parity in the pay scale of the employees of the High Court Registry on the lines of Punjab and Haryana High Court. Which was accepted by the state High Court.
After that the government went to the Supreme Court against it. The apex court also upheld the decision of the High Court. After this, the employees union filed an execution petition for non-compliance of the orders. During the last hearing, the government told the court that after holding a meeting, the department decided that this money would be released to the employees in four installments within two years, but this high pay increment has not been given to the employees yet.
During the hearing on Monday, the court said that the respondents are deliberately avoiding implementing the decision given by the court. According to the committee constituted by this court, a specific decision has already been taken regarding the amendment in the rules and payment of arrears in four installments. Despite that, the authority of the state government is stopping the recommendations made by such a committee.
