Benefits of seniority of contract service withdrawn from teachers and non-teachers in Himachal

This decision has been taken after the implementation of the Government Employees Recruitment and Service Conditions Amendment Bill 2024 in the state.

In Himachal Pradesh, all benefits have been withdrawn from teachers and non-teachers who took seniority of contract service period. On Monday, the Directorate of School Education issued instructions to give all the benefits only after regularization. This decision has been taken after the implementation of the Government Employees Recruitment and Service Conditions Amendment Bill 2024 in the state.

Employees will be entitled to service benefits only from the date of regularization of their services. The service benefits already given for service other than regular service will be withdrawn from them. Many teachers and non-teachers in the Education Department have been given seniority and financial benefits of contract service period on the orders of the High Court and Supreme Court.

In such a situation, the government has now decided that the petitioners of those petitions, which have been decided in accordance with CWP No. 2004/2017, titled Taj Mohammad vs. State of Himachal Pradesh and others, as well as CWP No. 629/2023 and whose services have been regularized after 12 December 2003, are not entitled to any benefits like seniority, increment, promotion etc. for the contract services rendered by them before regularization.

The representations of these petitioners as well as non-petitioners have been rejected. If any such benefits have been given to the employees, they will be withdrawn with immediate effect. After taking the decision not to give financial and seniority benefits of contract service period, the Education Department has started making lists of teachers and non-teachers who have received the benefits.
