Shimla: The High Court has taken strong cognizance of the case of not taking action against the police officers in the case of death of a person after assault in police custody in Kinnaur, Himachal Pradesh. The court has issued notices to the state government including CBI, Home Department, DGP in this case. A division bench of Chief Justice Gurmeet Singh Sandhawalia and Justice Satyen Vaidya heard the case. Now the case will be heard on January 10. In the petition, serious allegations have been made against the police officers by the wife. The guidelines of the National Human Rights Commission have been cited in the petition.
The guidelines state that if there is an encounter between the policemen and other people and death occurs, then the investigation of such cases will be handed over to some independent agencies. Instructions have also been given to give compensation to the person who died in police custody. Also, information about this has to be given to the commission. This petition has been filed in the High Court by the wife of the deceased person, Chandra Kala. Allegations have been made in the petition that on 8 August 2024, Kishore Kumar of Telangi village had a scuffle with the police and Home Guard jawan.
During the scuffle, the policemen beat the teenager with a helmet. He died after two days. An eyewitness during the incident filed a complaint in this matter. SP Kinnaur Abhishek suspended three policemen involved in the incident. In this case, the villagers demanded a fair investigation into the incident from the Reckong Peo police station in-charge. The police registered an FIR in this case and detained one policeman and no action was taken against the rest. A petition was filed in the High Court regarding this.
