Himachal: High Court orders to remove illegal structures and shops along NH-5

The next hearing has asked to file a fresh status report.

The Himachal Pradesh High Court has issued orders to cut off the electricity and water connections of illegal structures on National Highway-5, the lifeline of Upper Shimla, from Shimla-Kufri-Theog-Rampur. The court ordered the government and the Executive Engineer to immediately remove all the illegal shops built on the roadside. During the hearing of the PIL, the division bench of Chief Justice Gurmeet Singh Sandhawalia and Justice Ranjan Sharma also objected to the status report presented by the Superintendent of Police of Shimla and reprimanded him. The next hearing has asked to file a fresh status report.

The division bench has directed the government to take action under the law against all the motor mechanics, showrooms, dhabas and illegal businesses running on the roadside so that traffic can run smoothly on the national highway and they should be removed immediately. The Superintendent of Police of Shimla filed an affidavit in the court, in which he has said that action has been taken against those who have illegally occupied the land. 66 people have illegally occupied the roadside along the Shimla to Kufri, Fagu, Theog road.

Out of these, FIR has been filed against only two people. The court said, National Highway-5 is the lifeline of Upper Shimla. This road connects Shimla to Kinnaur. There is a jam everywhere on Hassan Valley which is near Dhali. Due to this, tourists along with the general public have to face trouble. Vehicles are parked illegally at various places along the road. Food and drink shops have been opened illegally. After the action, the court has asked the government to file a status report on this.
