In the reply filed in the court by the Waqf Board, it was claimed that the mosque is old and is built on the land of the Waqf Board.

Local Resident and Hindu Organization Advocate Jagat Pal claimed that the land on which the mosque is built is the government’s land and the Waqf Board has encroached it. He said that no effective action was taken in this case for 14 years.

He said that the owner of this land in the revenue records is the government. The Waqf Board did claim to be the owner of the land, but could not present any such record in the court. He said that in the Jamabandi, a non-existent mosque has been shown on Khasra number 36 meaning it has been built by encroaching government land. He also mentioned that case is not between Hindu or Muslim but only about the construction of illegal mosque.

Wakf Board’s advocate BS Thakur said that the court had issued notices to the board. We have filed the reply and presented evidence. The court has asked to file a state report. We will file its reply after examining the report.

Former head of the Sanjauli Mosque Committee Mohammad Latif claimed that this land belongs to the Wakf Board. Earlier a mosque was built with raw mud. Later he left the post of head. He does not know anything after that. ​​​​​​Wakf Board’s State Officer Qutubuddin said, “the land belongs to the Wakf Board. A one-storey mosque is also recorded in the records, but he knows who built it after that. Some Muslims came to Shimla from outside states and built a four-storey mosque.”
