HP High Court: Consumer Commission chairman’s tenure will be extended

The court said that the government has completed the selection process of members in October 2024.

The Himachal Pradesh High Court has passed an order to the government to extend the tenure of the Chairman of the State Consumer Commission. The court said that the current chairman will continue in his post until the government appoints a new chairman. The term of the chairman of the commission is ending on April 5.

The division bench of Justice Vivek Singh Thakur and Justice Ranjan Sharma has also ordered the government to appoint two members of the commission by April 4. The posts of members in the commission have been lying vacant for the last two years. The court said that the government has completed the selection process of members in October 2024.

Despite that, the appointment has not been made. A PIL was filed in the High Court regarding this. The petition states that if the State Consumer Commission remains vacant, it will affect the common people and the litigants.

The cases in the State Commission will not be settled soon. The state government should have completed the selection process six months ago, which has not been started yet. The High Court has passed this order on this.

The Himachal Pradesh High Court has taken strong cognizance of non-compliance of the court orders. The court said that the court orders are being disregarded under the guise of government instructions. During the hearing of the compliance petition, the division bench of Justice Tarlok Singh Chauhan and Justice Sushil Kukreja said that some departments of the government are suppressing the decision passed by the High Court and are giving the financial benefits due to the petitioners in installments instead of lump sum.
