Nikhil Sosale Arrest Case: Karnataka HC to hear RCB marketing head plea against arrest

The Karnataka High Court will hear the petition of RCB marketing head Nikhil Sosale today. Nikhil was arrested in connection with the stampede near the M Chinnaswamy Stadium on June 6. Sosale’s petition questions the legality of his arrest. It is also alleged that the police action was influenced by political instructions.

Nikhil’s lawyer told the court that the Central Crime Branch arrested him at the behest of CM Siddaramaiah. In the hearing on June 9, the court did not grant interim relief to Nikhil.

Justice SR Krishna Kumar said that the petition related to Nikhil Sosale will be heard separately at 10.30 am.

In the hearing on June 9, Sosale’s lawyer Sandesh Chauta questioned the court whether the police officers had the right to arrest Sosale. Nikhil was arrested by the Central Crime Branch (CCB), not the police investigating the case.

Chowta alleged that the arrest was not for any investigation but because the chief minister had issued instructions. Citing the DK Basu judgment, Chowta said that no one can be picked up without informing. The rights of the victim were violated.

The Karnataka government itself had told the court on June 5 that the investigation had been handed over to the CID, raising doubts over the jurisdiction of the CCB. When the case was handed over to the CID, how did the CCB come into the picture?

During the hearing, Justice Krishna asked if the Chief Minister had openly said that arrests would be made, to which the Advocate General said that he would have to check the records. Taking the side of the government, Shetty said that the officers were just doing their job. It is not that Nikhil was having lunch at a restaurant. He was going to the airport at 5 am, what should he do?

The AG said – Sosale’s remand had already been done, so there was no need for interim relief. Advocate General Shashi Kiran Shetty sought time to respond to the arguments.
