A three-member parliamentary committee set up to investigate allegations against Justice Yashwant Varma is expected to submit its report during the upcoming Monsoon Session of Parliament. The panel was constituted by Om Birla to examine the grounds for the judge’s removal following a controversy involving the recovery of burnt currency notes from his official residence in New Delhi.
According to sources in the Lok Sabha Secretariat, the committee’s findings will play a crucial role in determining whether impeachment proceedings against the judge will move forward in Parliament. The report is likely to be tabled when Parliament convenes for its Monsoon Session later this year.
Background of the Cash Recovery Controversy
The controversy began in March 2025 when a fire broke out at Justice Varma’s official residence in New Delhi. Firefighters and police officials reportedly discovered burnt and partially burnt currency notes at the premises while responding to the blaze.
The discovery triggered nationwide attention and raised questions about possible misconduct by a sitting High Court judge. Following the incident, Justice Varma was transferred from the Delhi High Court back to the Allahabad High Court, where he had previously served.
The incident led to political and legal debate about judicial accountability and transparency in India’s higher judiciary.
Motion for Removal in Parliament
The process for the judge’s removal was initiated after a proposal was submitted by 146 Members of Parliament seeking action against Justice Varma. The signatories included leaders from both the ruling party and the opposition, highlighting rare bipartisan support for investigating the allegations.
Under India’s constitutional framework, judges of the higher judiciary can only be removed through impeachment by Parliament. This requires a motion supported by a specified number of MPs and later a two-thirds majority vote in both Houses of Parliament.
After receiving the proposal, Lok Sabha Speaker Om Birla admitted the motion and constituted a three-member inquiry committee to examine the charges against the judge and determine whether there are sufficient grounds for removal.
Composition of the Inquiry Committee
The inquiry panel includes senior members of the judiciary and legal community. The committee currently includes Justice Aravind Kumar, senior advocate B V Acharya, and Justice Shree Chandrashekhar.
The committee was reconstituted earlier in 2026 after one of the original members stepped down. Its task is to review evidence, examine relevant documents and determine whether the allegations against Justice Varma amount to “proved misconduct” or incapacity under the law governing judicial removal.
Once the committee completes its investigation, it will submit its findings to the Lok Sabha Speaker, who will decide the next course of action in Parliament.
Possible Impact on Judicial Accountability
Legal experts say the case has become one of the most closely watched judicial controversies in recent years. The outcome could set an important precedent regarding how allegations against sitting judges are investigated and handled within India’s constitutional framework.
If the committee concludes that the charges are serious enough, Parliament may proceed with impeachment proceedings against Justice Varma during or after the Monsoon Session. On the other hand, if the panel finds insufficient evidence, the matter could be closed without further legislative action.
The upcoming report is therefore expected to be a key step in determining the future of the case and shaping debates around judicial integrity and accountability in India
