Kejriwal Moves HC Again, Alleges Judge’s Family Linked to Centre

New Delhi: Aam Aadmi Party (AAP) national convener and former Delhi Chief Minister Arvind Kejriwal has filed an additional affidavit in the Delhi High Court. In it, he has requested Justice Swarana Kanta Sharma to recuse herself from hearing the case.

Kejriwal said that the judge’s son and daughter are panel lawyers for the central government and are working for the government in the Supreme Court and Delhi High Court.

He described this as “not just a nominal position, but a continuous flow of government work and financial benefits.”

Questions on Case Allocation

The affidavit also stated that the Solicitor General, who is appearing on behalf of the CBI, is part of the process for allocating government cases.

Kejriwal alleges that this same system also assigns cases to the judge’s family, raising questions about impartiality.

Not an allegation of bias, but a concern

Kejriwal clearly stated that he is not directly accusing the judge of bias, but the circumstances raise “reasonable concerns” about a fair trial.

Objection to the hearing process

He also alleged that he was not given a chance to fully present his case and that the CBI’s arguments were heard for a long time.

He also objected to the court passing other orders while the recusal petition was pending.

Background of the Case

This case relates to a CBI petition challenging the trial court’s decision granting relief to Kejriwal, former Deputy CM Manish Sisodia, and other accused in the Delhi CM Manish Sisodia.

The Delhi High Court had previously reserved its judgment in the case after hearing arguments from Kejriwal and Solicitor General Tushar Mehta.
