Aklera, May 11: The trial court has issued an arrest warrant against BJP MLA Kanwar Lal in the case of pointing a pistol at the SDM and damaging government property.
The Supreme Court on Wednesday rejected Kanwarlal’s special leave petition (SLP). He was ordered to surrender before the trial court within two weeks.
Earlier, the ADJ Court, Aklera (Jhalawar) had overturned the trial court’s decision and sentenced him to 3 years imprisonment on 14 December 2020. The High Court and the Supreme Court also upheld that sentence and ordered Kanwarlal to surrender. Now after the arrest warrant is issued, the MLA can be arrested anytime.

SDM Ramniwas Mehta’s lawyer Ram Avtar Gupta said that this case was earlier pending in the ACJM court of Manohar police station. Later, MLA Kanwarlal Meena appealed against this decision in the Supreme Court, which was rejected.
The Supreme Court rejected all the arguments
On May 7, a three-judge bench of the Supreme Court (Justice Vikram Nath, Sandeep Mehta and Sanjay Karol) heard the case. The MLA’s lawyer Namit Saxena argued that neither the revolver nor the video cassette was recovered. Therefore, the case of criminal force or damage to government property does not stand. But the Supreme Court rejected these arguments.
The High Court had said – criminal background cannot be ignored
The High Court had also rejected the appeal, saying that Kanwarlal called himself a political person and disregarded the law instead of protecting it. There were already 15 criminal cases registered against him, even though he was acquitted in most of them, but the criminal background cannot be ignored.
What is the matter?
On 3 February 2005, the road was blocked due to elections in Jhalawar’s Manohar police station area. On receiving the information, SDM Ramnivas Mehta, probationer IAS Doctor Pritam and Tehsildar reached the spot. Kanwarlal Meena came there with his companions and pointed a pistol at the SDM’s temple, threatened to kill him if the re-counting was not done. He broke the photographer’s camera, burnt the cassette and also snatched the camera of another officer.
Threat to legislature
Under the Representation of the People Act, 1951, if a public representative is sentenced to more than 2 years, he can be disqualified for membership. In such a situation, Kanwarlal Meena’s assembly membership is in danger. The Assembly Secretariat has already issued a notice.
If you do not surrender, you will be arrested
Now that the Supreme Court has also refused to grant relief and the trial court has issued an arrest warrant, the MLA can surrender before the judicial magistrate in ACJM Court, Manoharthana or ADJ Court Aklera. If he does not do so, he will be arrested by the police.
