New Delhi: The issue of who will hoist the national flag on Indpendence Day in National Capital New Delhi has taken a new turn. Earlier, permission was sought from LG Saxena for Delhi Minister Atishi to hoist the national flag in place of Delhi CM Arvind Kejriwal who is lodged in Tihar Jail. Giving a major blow, Delhi GAD denied permission to Atishi to hoist the national flag on Independence Day.

The General Administration Department denies the Delhi CM Arvind Kejriwal’s request to authorize Minister Atishi Marlena to hoist the flag on August 15, stating that it is “legally invalid and cannot be acted upon.”

Earlier on Monday, Delhi Minister Gopal Rai in a letter gave direction to ensure the necessary arrangements for Atishi to hoist the flag in Chhatrasal Stadium as per the wish of Delhi CM Arvind Kejriwal, who is lodged in Tihar jail.

Referring to the Gopal Rai’s instruction, the letter issues by GAD said, “Independence Day and Republic Day are National events with supreme constitutional sanctity. There are detailed laid down provisions for celebrating them as per the stature they deserve. Any deviations thereto or subjugation thereof will not only undermine the sanctity associated with them, but may also amount to statutory illegality.”

Terming the communication of Delhi Chief Minister Arvind Kejriwal from jail as illegal, the letter said, “As per Rules 585, 588, 620 and 627 of Delhi Prison Rules, 2018 It is absolutely clear that the above communication does not qualify in the permissible communication which can be sent outside prison. Only private correspondence with a designated set of people as defined above is permissible. Therefore, any communication, written or oral, in contravention of the rules quoted above is not legally valid and therefore cannot be acted upon.”

General Administration Department further said that it has sought the convenience of the Chief Minister for his availability for the Independence Day Function but due to him being in judicial custody, the issue has been brought to the kind notice of the higher authorities and the decision is awaited.

General Administration along with all concerned Departments are making all arrangements for the Independence Day Function at Chhatrasal Stadium as per past practice.
