The All India Muslim Personal Law Board (AIMPLB) has termed the Supreme Court’s decision to grant alimony to divorced Muslim women as wrong. The working committee of the AIMPLB held a meeting on Sunday and discussed the Supreme Court’s decision.
A resolution was passed in this meeting that said this decision is against ‘Sharia’ (Islamic law). Therefore, the AIMPLB will explore all possible measures to ask the Supreme Court to overturn this decision.
In fact, the Supreme Court said on July 10 that a divorced Muslim woman is entitled to maintenance from her husband under Section 125 of the Code of Criminal Procedure (CrPC) (now Section 144 of the Indian Civil Protection Code). She can file a petition for this.
A bench of Justice BV Nagarathna and Justice Augustine George Masih gave this order while rejecting the petition of a Muslim youth Mohammad Abdul Samad. The Supreme Court said that this decision will apply to women of every religion. Muslim women have the same right to get alimony as women of other religions.
The Personal Law Board said in its proposal that the board stressed that the Prophet had said that divorce is the most disgusting thing among the things that are allowed. Therefore, all legitimate measures should be taken to maintain the marriage relationship.
Also, the guidelines given in the Quran regarding this should be followed. However, if it becomes difficult to maintain marital life, then divorce can be seen as a human solution.
This decision will create problems for divorced women
The proposal also said that the board feels that this decision of the Supreme Court will create more problems for those women who have successfully come out of their painful relationships.
AIMPLB spokesperson Syed Qasim Rasool Ilyas said after the meeting that the AIMPLB has allowed its president Khalid Saifullah Rahmani to explore all legal, constitutional and democratic measures to ask the Supreme Court to withdraw its decision.
