SC will Review Stray Dog Relocation in Delhi-NCR, Says CJI Gavai

New Delhi: Chief Justice of India B.R. Gavai on Wednesday stated that the Supreme Court will “look into” the issue of relocation of stray dogs in Delhi-NCR, offering a potential ray of hope for animal welfare advocates.

Background of the Case
The observation came after a lawyer referred to a plea on sterilisation and vaccination of community dogs in Delhi, citing a 2024 Supreme Court order by Justice J.K. Maheshwari-led Bench that barred the killing of stray animals and emphasized compassion as a Constitutional value.

Earlier Verdict on Stray Dog Relocation
CJI Gavai’s comments referred to a recent Monday verdict by Justices J.B. Pardiwala and R. Mahadevan, which directed municipal bodies across Delhi-NCR—including NDMC, MCD, and civic agencies in Noida, Gurugram, and Ghaziabad—to capture stray dogs and relocate them to shelters. Authorities were warned that obstruction would lead to strict legal action.

Public Safety Concerns Cited
The Pardiwala-led Bench cited serious public safety risks and rising rabies cases, calling the situation “grim” and urging immediate action to protect children, women, and the elderly. The court also ordered the construction of shelters if they did not exist and mandated reporting on infrastructure within eight weeks.

Widespread Criticism and Concerns
The verdict has sparked controversy. Congress MP and Lok Sabha Leader of Opposition Rahul Gandhi called it “a step back from decades of humane, science-backed policy.” Several animal welfare advocates and celebrities voiced their displeasure on social media, expressing concern for the voiceless animals.
