New Delhi: In a rare directive, the Supreme Court on Tuesday ordered a woman and her parents to issue a public apology for harassing her former husband and his family through multiple legal cases. The directive has been issued against an IPS officer and her family for filing false cases against her husband and his family. The court along with this order also directed to cancel all the ongoing cases against the latter.
Estranged Husband Father lodged in jail for over 100 days
The husband and his father were imprisoned for 109 and 103 days, respectively, due to cases filed by the woman. The bench, led by Chief Justice of India BR Gavai and Justice Augustine George Masih, noted that the husband and his family endured severe physical and mental trauma by the false legal proceedings.
Unconditional apology in Newspapers, Social media
The Court mandated that the woman and her parents publish an unconditional apology in the national editions of a prominent English and Hindi newspaper and on social media platforms, including Facebook, Instagram, and YouTube, within three days.
The Court clarified that this apology would not constitute an admission of liability or affect legal rights or obligations.
What’s the matter?
A woman IPS officer and her husband got married in 2015 and become parents to a daughter. The couple got separated in 2018 amid matrimonial disputes. Wife and Husband both took numerous mutual legal actions against each other.
The Court granted custody of the child to the mother, with the father and his family given supervised visitation rights. The wife also waived any claims to alimony, maintenance, or the husband’s property.
To resolve the conflict, the Court quashed all related criminal and civil cases and imposed additional terms and conditions. Exercising its powers under Article 142 of the Constitution, the Court also dissolved the couple’s marriage, directing that a decree of divorce be issued accordingly.
