    Punjab-Haryana HC Stays Punjab Govt’s Land Pooling Policy, Seeks response in 4 weeks

    Chandigarh, August 7: Today, on 7 August, the Punjab and Haryana High Court heard the land pooling policy of the Punjab government for the second consecutive day. The court has stayed the policy. The Punjab government has been asked to file a reply in 4 weeks. The court’s orders will be issued soon. After that the whole situation will become clear.

    The petitioner’s lawyer Charanpal Singh gave this information while talking to the media outside the court. During the last hearing on Wednesday, the court had put this policy of the government on hold for a day. This PIL has been filed by an advocate living in Ludhiana.

    The case of the 1947 partition was also raised in the court

    Lawyers said that many arguments were put forward. When the country was divided in 1947, even then, the farmers suffered. Nothing has been done for them till now. The court asked that when 65 thousand acres of land will be taken under land pooling, what will happen to the crops grown there? And what will be the future of the farm labourers working there?

    The government’s lawyers also argued in their favor. On this, the court said that the government has two options – either it withdraws this policy, or the court will cancel it. However, the government lawyers said that they will discuss the matter with the government and file an appropriate reply. In the end, the court gave the government four weeks to file a reply.

    The court raised two questions on the policy

    During the hearing, the court raised two important questions. The first question was whether an environmental assessment study has been conducted for this policy. The second question was what the provisions are for the rehabilitation of landless labourers and other people dependent on land.

    On this, Advocate General Maninder Singh Grewal sought time from the court to file a reply and said that this policy will remain suspended till August 7 and no further step will be taken till then.

    The court also said that in the case “Resident Welfare Association vs Chandigarh Administration” it has been made clear that environmental impact assessment is necessary before granting permission for urban development. The Punjab government had also made some amendments in the land pooling policy. Which was said to be in the interest of farmers.

    A person from Ludhiana had challenged the government

    This petition was filed in the High Court by Ludhiana-based advocate Gurdeep Singh. He himself is a farmer and his own land was coming under this policy. In such a situation, he challenged the land pooling policy on behalf of farmers and landowners.

    His argument was that clear rules have been laid down by the Central Government regarding land acquisition and the state government cannot change these central rules at its own will. The High Court had accepted his petition

    The government will give one lakh rupees until the possession of the plot is not given

    The land pooling policy was amended in the cabinet meeting of the Punjab government held on July 22. According to this, in land pooling, the government will give Rs 1 lakh annually to the farmers until they are given possession of the plot. If there is a delay in this, then this amount will be increased by 10 percent every year. At the same time, until the area is developed, the farmers will be able to do farming on it.

    CM said that we have made a plan for those farmers whose land is to be acquired which is less than one acre. They will be given plots for that. If a person does not want to take a commercial plot, then his residential area will be increased. Under the scheme, farmers will be given land in exchange for land.
