SC stays Punjab and Haryana High Court direction to reopen road in front of Punjab CM’s residence

The Punjab and Haryana High Court ordered to reopening the road on an Experimental basis from May 1

New Delhi: Pronouncing the order in a plea filed by the Punjab Government challenging the order given by the Punjab High Court, the Supreme Court today stays a direction issued by the Punjab Haryana High Court.

The Punjab and Haryana High Court ordered to reopening the road on an Experimental basis from May 1 outside the residence of Punjab Chief Minister Bhagwant Mann as it was causing inconvenience to the Public.

Supreme Court further issued notice on the appeal of the Punjab government challenging the directions of the High Court, asking the Chandigarh administration to open the road in front of the Chief Minister’s residence in Sector 2 for the public from May 1 on an experimental basis.

The road in front of Chief Minister’s residence was closed during the time of terrorism in the 1980s. Punjab government tells Supreme Court that in recent years there is resurgence of terrorism in the State and says grenades were thrown at its intelligence building.

A Bench of Justice Sanjiv Khanna and Justice Dipankar Datta heard the matter and posted it for hearing in September.

Defending Punjab Government, Advocate general of Punjab cited case of Sidhu Moosewala in which he was attacked 2 days after his security was reduced. He further added that who would take the responsibility if something unfortunate happens during the road is open for experimental basis.

In its order, SC directed that order of High Court for opening of the road to the CM’s house was stayed till next date. It further mentioned that proceedings in the writ petition were allowed to continue.

In an order passed on April 22, the Punjab and Haryana High Court had directed the Chandigarh police to formulate a traffic management plan to ease the traffic congestion by opening the road outside the Punjab CM’s residence on an experimental basis from May 1.

“We all feel that the inputs as such regarding the threat of drones and the RPGs being used would go on to show that the opinion is based on a closed mind-set of the authorities who are insensitive to the general public’s convenience,” said a bench presided over by Acting Chief Justice Gurmeet Singh Sandhawalia.
