    Rajasthan 2nd in custody deaths, 18 cases this year

    Rajasthan has recorded 18 custodial deaths so far in 2026, making it the second-highest state in the country after Bihar, according to data presented in Parliament.

    The figures were shared by the Ministry of Home Affairs in response to a query in the Lok Sabha, highlighting concerns over rising deaths in police custody across India.

    Bihar topped the list with 19 custodial deaths, while Rajasthan followed closely with 18 cases.

    Sharp rise in deaths this year

    The data shows a worrying trend, with custodial deaths increasing in several states. Rajasthan’s numbers have doubled compared to the previous year, where nine such deaths were reported in 2024–25.

    At the national level, 170 custodial deaths were recorded in just the first 74 days of 2026 (up to March 15)—a figure that already surpasses the total recorded in the previous financial year.

    This rise has raised alarm among policymakers and human rights observers.

    Other states also report high numbers

    Apart from Bihar and Rajasthan, other states with significant custodial deaths include:

    • Uttar Pradesh – 15 cases
    • Gujarat – 14 cases
    • Maharashtra – 14 cases
    • Punjab – 14 cases

    The data indicates that custodial deaths remain a widespread issue across multiple regions, not limited to a single state.

    Concerns over accountability and transparency

    The figures have once again brought attention to the issue of accountability within law enforcement agencies. Experts and rights groups have pointed out that in many cases; there is little to no disciplinary action taken against officials involved in custodial deaths.

    The lack of strict action has raised serious concerns about transparency and justice for victims and their families.

    Legal framework and safeguards

    India has several legal provisions aimed at preventing custodial violence, including safeguards under the Constitution and the Code of Criminal Procedure. These include mandatory judicial inquiries and protection against forced confessions.

    However, despite these safeguards, the persistence of custodial deaths suggests gaps in implementation and enforcement.

    Calls for reforms and stricter monitoring

    The rising numbers have led to renewed calls for reforms, including:

    • Installation of CCTV cameras in police stations
    • Independent investigations into custodial deaths
    • Faster judicial processes
    • Strict punishment for guilty officials

    Experts believe that stronger oversight mechanisms are necessary to ensure that such incidents are prevented in the future.

    Custodial deaths remain a critical human rights issue in India, reflecting systemic challenges in policing and justice delivery.
