    Rajasthan HC Lets Minor Girl Stay in Children’s Home

    The Rajasthan High Court has allowed a minor girl to continue staying in a government-run children’s home after she alleged torture at home and claimed that her father was involved in illegal activities. The decision was taken while hearing a petition seeking the custody of the minor girl.

    The court emphasized that the welfare and safety of the child must remain the top priority while deciding such sensitive cases involving minors. Courts often rely on child welfare principles when determining custody disputes or protective care arrangements.

    Allegations of Abuse and Illegal Activities

    According to the case details, the minor girl had reportedly approached authorities claiming that she had been subjected to harassment and torture at home. She further alleged that her father was involved in illegal activities, which created an unsafe environment for her to live in.

    The girl expressed fear of returning home and stated that she did not feel secure staying with her father. Due to these serious allegations, the matter was taken up by the Child Welfare Committee (CWC) and later reached the High Court for further consideration.

    Child Welfare Committee’s Role

    The Child Welfare Committee had earlier ordered that the minor be kept in a Children’s Home, a protective facility meant for minors who require care and protection under the Juvenile Justice (Care and Protection of Children) Act.

    Such homes provide shelter, education, counselling, and protection to children who are victims of abuse, neglect, or unsafe family environments. The committee believed that keeping the girl in protective custody was necessary until the allegations were properly examined.

    Father Approaches Court for Custody

    The girl’s father reportedly approached the High Court challenging the decision and seeking custody of his daughter. He argued that the child should be allowed to return home and that keeping her in the children’s home was unnecessary.

    However, during the hearing, the court took note of the minor’s statements and her apprehensions regarding her safety if she were forced to return to her family home.

    Court Prioritizes Welfare of the Child

    After hearing both sides, the Rajasthan High Court ruled that the minor girl should continue staying in the Children’s Home for the time being. The court observed that when dealing with cases involving minors, the child’s welfare and best interests must override other considerations, including parental claims.

    The bench also indicated that the allegations raised by the girl need to be properly examined before any final decision regarding custody is taken.

    Further Inquiry Expected

    The authorities are expected to conduct further inquiry into the allegations made by the minor girl. Investigations may include verification of claims about abuse, examination of the family environment, and counselling of the child to determine the most suitable long-term arrangement.

    The High Court’s interim decision ensures that the girl remains in a safe and supervised environment while the matter is investigated.

    The case highlights the significance of India’s child protection framework, particularly the Juvenile Justice Act, which allows authorities to intervene when a minor’s safety is at risk.
