Sanjauli Mosque Case: Himachal High Court to hear matter today

The much-discussed Sanjauli Mosque case in Shimla, the capital of Himachal Pradesh, continues to escalate. The matter has now reached the Himachal High Court. A hearing will be held later today. The Waqf Board has filed a petition in the High Court challenging the demolition order. A division bench of Justice Vivek Singh Thakur and Justice Romesh Verma will hear the case.

District Court ordered the demolition of the Mosque 

On October 30th, the District Court delivered a significant verdict in the Sanjauli Mosque case. The court upheld the decision of the Commissioner’s Court of the Shimla Municipal Corporation (MC), declaring the mosque’s lower two floors illegal and ordering the demolition of the mosque. The court dismissed the petitions of the Waqf Board and the Sanjauli Mosque Committee, stating that the entire mosque was built on government land.

Modifying a portion of the Commissioner’s Court’s decision, the court ordered the Waqf Board and the Mosque Committee to demolish both floors within two months. The court stated that if action is not taken within the stipulated time, the Municipal Corporation will remove the illegal construction and recover the entire cost from the defendants.

The Waqf Board has now appealed to the High Court against the decision.

What has happened in the case so far?
On May 3rd of this year, the Municipal Commissioner’s Court declared the entire mosque structure illegal and ordered its demolition. The Waqf Board and the Mosque Committee challenged this order in the Sessions Court.

The District Court held that the construction was carried out without valid permission and was a clear violation of regulations. The Municipal Corporation informed the District Court that a new four-story building was constructed after the old structure of the mosque was demolished.

Neither permission nor approval was obtained for its construction. The Municipal Commissioner’s Court ordered the demolition of the unauthorized structure on October 5th, 2024.
