New Delhi: The Supreme Court on Monday declined to entertain petitions filed against Assam Chief Minister Himanta Biswa Sarma, asking the petitioners to approach the Gauhati High Court instead.
Apex Court Says HC is Appropriate Forum
A Bench of the apex court observed that the appropriate forum to examine the grievances raised in the petitions would be the High Court, which has jurisdiction over the matter.
Liberty Granted to File Fresh Plea
While refusing to hear the pleas, the court granted liberty to the petitioners to file their petitions before the Gauhati High Court in accordance with law.
The Bench noted that it was not inclined to exercise its jurisdiction under Article 32 of the Constitution in the present case and emphasised that the High Court is competent to adjudicate the issues raised.
No Observations on Merits of Case
The petitions reportedly contained allegations concerning actions and statements attributed to the Assam Chief Minister. However, the Supreme Court did not go into the merits of the matter.
Instead, it reiterated that the High Court should be approached first for appropriate relief.
The order effectively means that any further proceedings in the matter will now take place before the Gauhati High Court.
